These Terms of Service (“Terms”) govern your access to and use of Stakmon.com and your purchase of products from Stakmon.
Stakmon.com is operated by Stakmon Ventures LLP (“Stakmon”, “we”, “us” or “our”). Our online store is powered by Shopify, which provides the ecommerce platform through which we offer our products and services.
By accessing our website, creating an account or placing an order with us, you agree to these Terms together with the policies referenced in them, including our Privacy Policy, Shipping Policy and Returns, Exchanges & Refunds Policy.
Nothing in these Terms is intended to exclude, restrict or override any rights or remedies available to you under applicable Indian law, including applicable consumer protection law.
1. Eligibility and Use of Our Website
You must be legally capable of entering into a binding contract to purchase products from us.
You may use Stakmon.com only for lawful purposes. You must not:
- use the website in violation of applicable law;
- attempt to gain unauthorised access to the website, accounts or systems;
- introduce viruses, malware or other harmful code;
- interfere with the security or operation of the website;
- scrape, reproduce or commercially exploit website content without our permission; or
- use the website in a fraudulent, misleading or abusive manner.
We may restrict or suspend access where reasonably necessary to protect Stakmon, our customers, our systems or other users.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, specifications, sizing information, photographs, colours, features, prices and other information displayed on Stakmon.com are accurate and helpful.
However, minor differences may occur between how a product appears on screen and the physical product, including differences caused by device displays, photography, manufacturing tolerances or product improvements that do not materially alter the product.
Please review product descriptions, sizing guidance, instructions, warnings and other information provided with a product before use.
Where a product includes specific indications, contraindications, precautions or warnings, these form an important part of the product information and should be reviewed before use.
Products and product availability may be changed or discontinued from time to time.
Nothing in this section limits your rights where a product is defective, damaged, incorrect, misdescribed or otherwise does not conform to applicable legal requirements.
3. Medical Devices, Product Use and Health Guidance
Stakmon offers support and recovery products designed to provide functional support, stability, compression, comfort and/or hot and cold therapy, depending on the specific product and its intended use.
Certain Stakmon products are registered in India as Class A (non-sterile and non-measuring) medical devices under the applicable medical device regulatory framework. Class A represents the low-risk category under India’s risk-based medical device classification system.
The regulatory classification, intended use, indications, contraindications, precautions, warnings and instructions applicable to a particular product should be understood by reference to the information provided for that specific product and its packaging. A regulatory classification does not mean that a product is appropriate for every person, condition or circumstance.
Each Stakmon product should be selected and used in accordance with its intended use, product description, sizing guidance, instructions, indications, contraindications, precautions and warnings.
Information provided through Stakmon.com—including product descriptions, indications, educational content, articles, FAQs, sizing guidance and customer-support guidance—is intended to help you understand our products and their appropriate use. It is not intended to diagnose a medical condition or replace personalised medical advice, diagnosis or treatment from a qualified healthcare professional.
Individual needs and medical circumstances vary. If you have a significant or persistent injury, severe or worsening pain, impaired circulation or sensation, a known medical condition, have recently undergone surgery, or are uncertain whether a Stakmon product is appropriate for your circumstances, consult an appropriately qualified healthcare professional before use.
Do not use a product for a purpose inconsistent with its intended use or contrary to its instructions or warnings. Stop use and seek appropriate medical advice if you experience significant or worsening pain, numbness, unusual swelling, skin irritation or another concerning reaction while using a product.
Stakmon does not provide individual medical diagnoses or treatment through its website, customer support or other general communications unless expressly provided by an appropriately qualified healthcare professional acting in that capacity.
Nothing in this section excludes or limits Stakmon’s obligations, or your rights and remedies, concerning product quality, safety, performance, description or fitness under applicable law.
4. Prices and Taxes
Prices displayed on Stakmon.com are in Indian Rupees (INR).
Unless expressly stated otherwise, prices displayed to customers are inclusive of applicable Goods and Services Tax (GST).
We may change prices, offers or promotions from time to time. Any price change will not affect an order that we have already accepted, except where an obvious pricing or technical error has occurred and subject to applicable law.
Any applicable charges will be shown before you complete checkout.
5. Orders and Order Acceptance
When you place an order through Stakmon.com, you are making an offer to purchase the selected products.
Receiving an automated order acknowledgement or confirmation does not prevent us from cancelling an order where there is a legitimate reason to do so, including:
- a product becoming unavailable;
- an obvious pricing, listing or technical error;
- inability to verify or process payment;
- an incorrect or incomplete delivery address that prevents fulfilment;
- suspected fraud or unauthorised activity; or
- quantities suggesting unauthorised commercial resale.
If we cancel a prepaid order after payment has been received, we will refund the applicable amount in accordance with our Returns, Exchanges & Refunds Policy and applicable law.
We may reasonably limit quantities where necessary to manage inventory, prevent misuse or restrict unauthorised resale.
6. Payment
We accept the payment methods displayed at checkout.
Payments may be processed by third-party payment service providers and are subject to their applicable processing requirements.
You agree to provide accurate and authorised payment and billing information.
Cash on Delivery (“COD”) may be available for eligible orders and serviceable locations. Availability will be shown at checkout and may be subject to reasonable verification.
7. Shipping and Delivery
We currently ship within India.
Shipping availability, dispatch estimates, delivery timelines, tracking, delivery attempts and other delivery terms are described in our Shipping Policy.
Delivery dates and timelines are estimates rather than guarantees unless expressly stated otherwise.
You are responsible for providing complete and accurate delivery information. If you identify an error in your address or contact information, please contact us as soon as possible. We will try to correct it before dispatch where reasonably possible.
8. Cancellations, Returns, Exchanges and Refunds
Cancellation, return, exchange and refund requests are governed by our Returns, Exchanges & Refunds Policy.
Please review that policy before making a purchase, particularly the applicable timeframes, eligibility criteria and product-condition requirements.
Nothing in our Returns, Exchanges & Refunds Policy affects rights or remedies available to consumers under applicable law.
9. Promotions and Discount Codes
From time to time, Stakmon may offer discounts, promotional codes, bundles or other promotional offers.
Promotions may be subject to additional terms communicated with the relevant offer, including eligibility, validity periods, product exclusions, usage limits or minimum purchase requirements.
Unless otherwise stated:
- promotional offers cannot be exchanged for cash;
- discount codes cannot be applied retrospectively to completed orders; and
- multiple offers or codes may not be combined.
We may withdraw or modify a promotion before an order is placed, subject to applicable law. Orders already validly placed under an applicable promotion will not be retrospectively repriced merely because the promotion subsequently ends.
10. Accounts and Customer Information
If you create a customer account, you are responsible for maintaining the confidentiality of your account credentials and for providing accurate and current information.
Please notify us if you believe your account has been accessed without authorisation.
Our collection and handling of personal data is governed by our Privacy Policy.
11. Reviews, Feedback and User Content
You may have opportunities to submit reviews, feedback, photographs, comments or other content.
You are responsible for content you submit and must not submit content that is unlawful, misleading, defamatory, abusive, infringes another person’s rights or contains malicious software.
By voluntarily submitting content for publication, you grant Stakmon a non-exclusive, royalty-free licence to use, reproduce, display and adapt that content for operating, improving and promoting Stakmon and our products, subject to applicable law and our Privacy Policy.
We may moderate or remove content where reasonably necessary, including content that violates these Terms or applicable law.
12. Intellectual Property
The content of Stakmon.com—including our brand names, trademarks, logos, product names, photographs, graphics, videos, written content, website design and other materials—is owned by or licensed to Stakmon Ventures LLP and is protected by applicable intellectual-property laws.
You may access and use the website for your personal, non-commercial use.
You may not reproduce, modify, distribute, publish, sell, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.
13. Third-Party Services and Links
Our website may use or link to third-party services, including ecommerce, payment, logistics, communications, social-media and other technology providers.
Third-party websites and services may be governed by their own terms and privacy practices. We do not control third-party websites and are not responsible for their independent content or practices.
This does not limit Stakmon’s responsibility to you for services we have engaged third parties to perform on our behalf where responsibility remains with us under applicable law.
14. Website Availability, Accuracy and Errors
We aim to keep Stakmon.com accurate, secure and available, but we cannot guarantee that the website will always operate uninterrupted or error-free.
Occasionally, information may contain typographical, pricing, availability or other errors. We may correct errors and update website information when identified.
Where an error affects an order you have already placed, we will handle the matter reasonably and in accordance with applicable law.
We may temporarily suspend or modify website functionality for maintenance, security, technical or operational reasons.
15. Product Use and Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any rights or remedies available to consumers under applicable law.
To the maximum extent permitted by law, Stakmon will not be liable for indirect, incidental, special or consequential losses arising solely from use of the website where such losses were not reasonably foreseeable.
Stakmon is not responsible for loss or harm resulting from misuse of a product, use contrary to the product’s intended use, instructions, contraindications, precautions or warnings, unauthorised alteration of a product, or use outside the circumstances for which the product was designed, except to the extent that liability cannot lawfully be excluded or limited.
Products should not be used as a substitute for professional medical assessment or treatment where such assessment or treatment is reasonably required.
Nothing in these Terms excludes or restricts liability for defective products, applicable product-safety obligations, fraud, wilful misconduct, gross negligence or any other liability that cannot lawfully be excluded or restricted.
16. Indemnity
To the extent permitted by applicable law, you agree to be responsible for losses or claims reasonably incurred by Stakmon as a direct result of your unlawful use of the website, deliberate breach of these Terms or infringement of another person’s rights.
This provision does not apply to losses caused by Stakmon or otherwise allocated to us under applicable law.

18. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, business practices or applicable legal and regulatory requirements.
The updated Terms will be posted on Stakmon.com with a revised “Last updated” date.
Changes will not retrospectively reduce rights relating to an order already placed where doing so would be inconsistent with applicable law.
19. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law, and the remaining provisions will continue in effect.
20. Governing Law and Disputes
These Terms are governed by the laws of India.
Nothing in these Terms limits your right to seek remedies before a competent consumer commission, court or other authority having jurisdiction under applicable law.
Where permitted by law, other disputes arising in connection with these Terms or the use of Stakmon.com will be subject to the jurisdiction of the competent courts in Mumbai, Maharashtra, India.
